Value of the SAS index point
The basic remuneration of employees is calculated in accordance with the provisions of this agreement, with the career grid for employees set out in article 23, and with the value of the index point. The monthly value of the SAS index point (Secteur d’aide et de soins et du secteur social – care, assistance and social sector) at index figure 100 of the applicable rate of the sliding wage scale is set as follows: €2.41733 (value as at 1 January 2021).
In determining the value of the SAS index point through the application of the sliding wage scale, the first five decimal places are used, applying commercial rounding.
General provisions
- 1. The employer retains full discretion to hire an employee holding a given certificate or diploma for a post corresponding to a career different from that of their diploma. Nevertheless, where a vacancy is announced in a given career, the employer may not hire a holder of the certificate or diploma corresponding to the vacancy in a career with a lower level of remuneration.
- 2. Disputed cases are to be submitted to the joint committee defined in article 5, which also has the power to propose new careers where needed, in accordance with the established salary hierarchy.
- 3. Obtaining a new diploma (other than the one on the basis of which they were hired) does not entitle the employee to a change of career.
- 4. An employee intending to acquire a certificate or diploma while in employment, relating to training decided by mutual agreement between the employee and the employer, is hired in the career corresponding to the minimum qualification required for admission to the training, without recognition of any seniority and for a maximum duration of six years.
- Failure to obtain the intended diploma at the end of the six years, or abandonment of the training, constitute sufficient grounds for termination of the employment contract. This period is extended by the waiting time, not attributable to the employee, before the training can begin.
- If the training is successfully completed, the employee remains classified in the career mentioned above until such time as they can qualify for classification in a career corresponding to their new qualification. In this case, the employee will move to the new career concerned with the number of points acquired being carried over or, where applicable if this should be more favourable, their seniority in the new career will be reconstituted by recognising the minimum duration required for the training as years of seniority. The month during which the employee moves to the new career is to be regarded as the new anniversary month from which they will advance by one seniority grade each year.
Table of careers and remuneration scales
The employee is hired in the career corresponding to the profession required for the post they hold, provided that they hold at least the required qualification, evidenced by a Luxembourg certificate or diploma or one recognised as equivalent in the Grand Duchy of Luxembourg.
