Right to disconnect

Article 36 of the CCT SAS 2025 enshrines the employee's right to disconnect, in line with the Luxembourg law of 28 June 2023 on the subject.
Principle
In order to ensure that rest periods and leave are respected, the employer takes the necessary measures to ensure that the employee disconnects outside their working time.
Contact outside working time
The employer may only contact the employee in the event of an emergency in order to ensure the continuity of the service. This measure does not apply to periods during which the employee is on stand-by duty (see article 9 D).
No penalties
The failure to answer calls or emails outside working hours (and outside a stand-by period) cannot give rise to:
- any disciplinary consequence for the employee;
- any negative consequence for the organisation of their working time.
